1. Service Description

Snow Fox Kids ("we," "us," or "our") is an educational platform designed for children ages 4-14. The Service, accessible at snowfoxkids.com, provides interactive learning games, activities, and tools across multiple subjects including Math, Reading, Science, History, Art, Geography, Coding, and more.

The Service includes features such as gamified learning activities, boss battles, a crafting system, pet fox companions, multiplayer challenges, a parent dashboard, and cross-device progress syncing.

2. Account Terms

2.1 Account Creation

• You must be a parent, legal guardian, or authorized adult (18 years or older) to create a Snow Fox Kids account.
• Children may not create accounts on their own. All accounts must be created by a parent or guardian.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must provide accurate and complete information during registration.

2.2 Child Profiles

• Parents may create child profiles under their account for their children to use the Service.
• Each child profile includes a display name, age, and avatar.
• Parents are responsible for supervising their children's use of the Service.
• By creating a child profile, you consent to the collection and use of your child's information as described in our Privacy Policy.

3. Subscription Terms

3.1 Plans and Pricing

Snow Fox Kids offers the following subscription options:

• 3-Day Free Trial: Full access to all features for 3 days. No credit card required to start. Up to 3 child profiles included.
• Family Plan: $19.99 per month. Includes up to 3 child profiles with full access to all subjects, games, features, and content.
• Extra Kids: $4.99 per additional child per month, for families who need more than 3 child profiles.

3.2 Free Trial

• New users are eligible for one 3-day free trial per household.
• The trial provides full, unrestricted access to all features.
• At the end of the trial period, you may subscribe to continue using the Service or your access will be limited.
• We will not automatically charge you at the end of the trial. You must actively choose to subscribe.

3.3 Billing

• Subscriptions are billed monthly on the anniversary of your subscription start date.
• Payments are processed securely through Stripe. We do not store your credit card information on our servers.
• Prices are in US Dollars (USD) and may be subject to applicable taxes.
• We reserve the right to change our pricing with 30 days' advance notice to existing subscribers.

3.4 Cancellation Policy

• You may cancel your subscription at any time through your account settings or by contacting us at support@snowfoxkids.com.
• Upon cancellation, you will continue to have access to all paid features until the end of your current billing period.
• No refunds will be issued for partial months of service.
• Your child's learning data and progress will be retained for 90 days after cancellation in case you wish to resubscribe. After 90 days, data may be permanently deleted.
• You may request immediate data deletion at any time by contacting us.

3.5 Refunds

We offer refunds on a case-by-case basis. If you are unsatisfied with the Service, please contact us at support@snowfoxkids.com within 14 days of your most recent payment. We will work with you to resolve the issue or provide a refund.

4. Acceptable Use

By using Snow Fox Kids, you agree that you and any children using your account will not:

• Harass or bully: Engage in any form of harassment, bullying, or intimidation of other users in multiplayer features or any other part of the Service.
• Share inappropriate content: Use any communication features (if available) to share content that is violent, sexual, hateful, or otherwise inappropriate for a children's platform.
• Cheat or exploit: Use bots, scripts, hacks, exploits, or any other unauthorized means to gain an unfair advantage, manipulate game systems, or bypass intended functionality.
• Impersonate others: Pretend to be another person, including another user, a Snow Fox Kids staff member, or any other individual.
• Misuse the platform: Use the Service for any purpose other than educational use by children and family members.
• Reverse engineer: Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Service.
• Circumvent security: Attempt to bypass, disable, or interfere with any security features of the Service.
• Disrupt service: Take any action that imposes an unreasonable load on our infrastructure or interferes with the proper functioning of the Service.

We reserve the right to suspend or terminate accounts that violate these rules, with or without notice.

5. Intellectual Property

5.1 Our Content

All content on Snow Fox Kids, including but not limited to text, graphics, logos, icons, images, audio, video, educational materials, game designs, character designs (including the Snow Fox mascot), software, and code, is the property of Snow Fox Kids or its licensors and is protected by copyright, trademark, and other intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial, educational purposes in accordance with these Terms. This license does not include the right to:

• Reproduce, distribute, or publicly display any content from the Service.
• Modify, create derivative works from, or adapt any content from the Service.
• Use any content for commercial purposes.
• Remove any copyright, trademark, or other proprietary notices.

5.3 User-Generated Content

If the Service allows children to create content (such as custom quizzes, drawings, or other creative work), the child and their parent retain ownership of that content. By creating content on the platform, you grant us a limited license to display and store that content as needed to provide the Service.

6. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from using the Service will be accurate or reliable.
• The Service will meet your specific educational requirements or expectations.
• Any errors in the Service will be corrected.

Snow Fox Kids is a supplemental educational tool and is not intended to replace formal education, tutoring, or professional educational assessment.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

• Snow Fox Kids, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or interruption of service, arising out of or in connection with the use of or inability to use the Service.
• Our total liability for any claims arising from or related to these Terms or the Service shall not exceed the amount you paid to us for the Service in the 12 months preceding the claim.
• Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless Snow Fox Kids, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

9. Modifications to the Service

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We may add, change, or remove features, content, games, or subjects. We will make reasonable efforts to notify users of significant changes that affect their subscription.

10. Changes to These Terms

We may update these Terms of Service from time to time. If we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after the revised Terms become effective constitutes your acceptance of the changes.

If you do not agree to the revised Terms, you must stop using the Service and cancel your subscription before the changes take effect.

11. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Snow Fox Kids regarding the use of the Service, and supersede any prior agreements or understandings.
